Ich kann mit der Zukunft sprechen und du auch. Wir alle können. Die Schriften, die wir heute schreiben und die Worte, die wir heute sagen, konnten jahrelang widerhallen. Die Frage dann ist, kann die Zukunft zurück sprechen? Retrokausalität ist eine alte Idee, nach denen die Zukunft die Vergangenheit beeinflussen können. Es war Gegenstand vieler Diskussionen. Die erste Kritik sozusagen fragt, wie kann etwas die Vergangenheit beeinflussen, wenn man es vermeiden kann. Viele weitere folgten, in Bezug auf Paradoxen und Zeitschleifen. Die Möglichkeit bleibt jedoch, wenn wir in einem zyklischen Universum leben, das diese Idee Realität werden konnte. Wenn die Zeit ein flacher Kreis ist, kann die Träum, oder Albtraum, der Ewige Wiederkunft wahr sein. Du könntest auch das alles schon erlebt, das alles schon gesehen. Tengo un amigo de Chile. Él es el novio (pololo según él) de mi mejor amiga, quien es americana. Está en los Estados Unidos para ganar su doctorado en la planificación urbana de la universidad de Portland State. Mi mejor amiga está intentando aprender español también para que pueda hablar con la familia de su pololo y porque ellos necesitarán vivir en Chile por cinco años a cause del typo de beca que el pololo tiene. Ayer, nos tres fueron a un bar (exterior, con mascaras), y intenté hablar español contigo para practicar. No sé si fue las cervezas o algo otro, ¡pero no pude hablar español sin importar cuánto lo intenté! ¡Esta mañana, tengo una nueva determinación de estudiar mi español!

Mein französischer Lehrer war immer ein sehr intelligenter und netter Mann. Einen Tag er ist ein bisschen traurig gekommen. Vor dem Unterricht hat er mir erzählt, dass sein bester Freund hat ihn nicht zu seiner Geburtstagsparty eingeladen habe. Das konnte ich nachempfinden. Er erklärte mir, wie enttäuschend es sei, dass die Leute, die man für wichtig halte, nicht im Gegenzug tuen.

QUESTION PRESENTED
Under the New York Dram Shop Act, which requires a plaintiff to establish that a defendant served alcohol to a “visibly intoxicated” person, could the court find that the patron was visibly intoxicated at the time of service when the current evidence suggests that (1) she did not slur her words or lost her balance at the bar, (2) exhibited glassy eyes, tripped over the doorframe, and consumed more alcohol after leaving the bar, and (3) failed the field sobriety test and had a Blood Alcohol Content (BAC) of 0.182 at least 1 1/2 hours after the time of service?
BRIEF ANSWER
No. The current evidence could not prove that The Devil’s Advocate served alcohol to Eleanor Shellstrop when she was “visibly intoxicated.” To support a finding of visible intoxication, a court will consider all direct and circumstantial evidence. The less circumstantial evidence is in temporal proximity to the service of the bar, the less likely it is to support a finding of visible intoxication. Here, direct proof of intoxication is absent. Circumstantial evidence is insufficient because there is only one piece of circumstantial evidence in temporal proximity to the service of alcohol. Further alcohol consumption and a substantial time gap between the service and the later evidence severs the evidentiary link to support an inference of visible intoxication.
STATEMENT OF FACTS
In the evening of July 26, 2019, Shellstrop spent several hours with her friend at a bar called The Devil’s Advocate, the defendant, and drank four Martinis and two beers. The bartender on shift testified that he continued to serve Shellstrop because she neither slurred her words nor lost her balance. Shellstrop paid her bill at 11:03 p.m. and left shortly after.
Shellstrop returned to her apartment around 11:15 p.m. and drank two beers. Her housemate testified that the only sign of drinking he noticed was “glassy eyes.” Although Shellstrop tripped over the doorframe when she came in, there was “a bump to watch out for,” and the same happened when she first moved in. Shellstrop did not stagger, wobble, or slur her words. They talked for an hour until Shellstrop left around 12:15 a.m. on July 27, 2019.
At 12:30 a.m., the police found that Shellstrop ran a red light and struck the car of Chidi Anagonye. The police officer smelled alcohol on her breath, administered the standardized field sobriety test, and determined that she was intoxicated. Her BAC was 0.182, above the legal limit of 0.08. Anagonye sued The Devil’s Advocate under the Dram Shop Act, which requires him to prove that The Devil’s Advocate served alcohol to Shellstrop when she was “visibly intoxicated.”
DISCUSSION
The current evidence cannot prove that Shellstrop was “visibly intoxicated” when The Devil’s Advocate served her. Under the Dram Shop Act, a party who unlawfully sells alcohol to another person is liable for injuries caused by that person’s intoxication. N.Y. Gen. Oblig. Law § 11-101 (McKinney 1980). Furnishing alcohol to a visibly intoxicated person is unlawful. N.Y. Alco. Bev. Cont. Law § 65(2) (McKinney 2016). The term “visible” does not create a rigid requirement of direct proof: when direct proof is absent, circumstantial evidence can also prove visible intoxication. Romano v. Stanley, 90 N.Y.2d 444, 450 (1997). The court will weigh all the evidence together to determine whether a finding of visible intoxication is warranted. Adamy v. Ziriakus, 92 N.Y.2d 396, 401 (1998).
Direct proof is testimony from a person who observed the allegedly intoxicated person’s demeanor “at the time and place that the alcohol was served.” Id. This may include alcohol on the person’s breath, glassy and bloodshot eyes, slurred speech, and poor motor coordination. See id. at 450. A large amount of alcohol consumed in a short time is not valid evidence because “tolerance for alcohol is subject to wide individual variation.” Romano, 90 N.Y.2d at 450; Csizmadia v. Town of Webb, 289 A.D.2d 854, 856 (N.Y. App. Div. 2001) (four drinks in an hour).
Circumstantial evidence includes expert and eyewitness testimony, police officers’ accounts, and lab reports. See Romano, 90 N.Y.2d at 450–51. The more circumstantial evidence is in temporal proximity to the time of service, the more likely it is to cumulatively support a finding on visible intoxication. See Adamy, 92 N.Y.2d at 403 (holding that expert testimony, police officers’ accounts from the accident scene, high BAC level, the non-testifying of the bartender on shift, and the short time between the patron’s departure from the bar and the accident provided ample evidence of visible intoxication). On the other hand, a single piece of circumstantial evidence in temporal proximity is generally insufficient to support a finding of visible intoxication. See Adamy, 92 N.Y.2d at 401 (high BAC alone); Romano, 90 N.Y.2d at 441 (expert testimony alone); Meizinger v. Akin, 192 A.D.2d 1011, (App. Div. 3rd Dept. 1993) (expert testimony alone); Senn v. Scudieri, 165 A.D.2d 346, 351–52 (1s Dep’t 1991) (slurred speech alone).
There may be an alternative explanation for signs of intoxication. Poor motor coordination can be warranted by the circumstances and thus unable to support an inference of visible intoxication. For example, in Csizmadia, parking on the slope and prior clumsiness were an alternative explanation other than intoxication for the patron’s loss of motor control. Csizmadia, 289 A.D.2d at 856.
A substantial time gap and intermediate drinking can weaken the inferential ability of circumstantial evidence. When the later evidence is not in temporal proximity to the service and the patron drinks more alcohol in the interim, the court is not likely to find visible intoxication at the time of service even when the patron is very intoxicated at the later time. See, e.g., Terbush v. Buchman, 147 A.D.2d at 828–29 (granting summary judgment for the defendant when the person consumed liquor in another bar and the accident occurred two hours later); Meizinger, 192 A.D.2d 1013–14 (granting summary judgment for the defendant when the person consumed three or four beers in another bar and the accident occurred 2 1/2 hours later); Donato v. McLaughlin, 195 A.D.2d 685, 688 (N.Y. App. Div. 1993); Sorensen v. Denny Nash Inc., 249 A.D.2d 745, 748 (N.Y. App. Div. 1998); cf. Adamy, 92 N.Y.2d at 404 (affirming the jury verdict for the plaintiff when the accident occurred “only a short time after”).
Here, the current evidence is insufficient to support a finding of visible intoxication.
Direct proof is absent because the affidavit of the bartender suggests no sign of intoxication. Shellstrop neither slurred her words nor lost her balance. Four martinis and two beers in a few hours is not a proof of visible intoxication because the effect of alcohol may vary from person to person.
Circumstantial evidence is also insufficient because the only evidence in temporal proximity to the service of alcohol is her glassy eyes, which is 15 minutes after Shellstrop left the bar. One sign alone is not likely to support a finding of visible intoxication.
Although Shellstrop stumbled on her way into her apartment, the court will not find this to be a sign of intoxication because the unusual bump in the doorframe provides an alternative explanation for her stumble. Indeed, Shellstrop tripped over a doorframe so conspicuous that one could not reasonably ignore its presence, but she had displayed the same clumsiness before when she was sober. Similar to Csizmadia, where the person’s motorcycle fell over on a slope, just as it had happened before, the bump could have caused Shellstrop to trip over the doorframe, just as it did when she first moved in.
The time gap and intermediate drinking weaken the inferential ability of later evidence. Although the police report and the lab report of high BAC level can prove that Shellstrop was visibly intoxicated at the time of the accident, the evidence was at least 1 1/2 hours after Shellstrop left The Devil’s Advocate and she drank two beers in the meantime. In all similar cases with a substantial time gap and intermediate drinking, the court rejected a finding of visible intoxication. Since the 1 1/2 hour gap makes the present case factually more similar to Terbush and Meizinger than Adamy, the court is not likely to find the circumstantial evidence sufficient.
CONCLUSION
With the current evidence, the court is not likely to find that the patron was visibly intoxicated. Direct proof is absent and circumstantial evidence is insufficient because one piece of circumstantial evidence in temporal proximity cannot justify an inference of intoxication. The substantial time gap and intermediate drinking weaken the inferential ability of later evidence. Further testimony from Shellstrop herself, her friend at the bar and cross-examination of the bartender may prove otherwise.

Recently, I want to practice Zazen or meditation again because my mind was very chaos these days. The Zazen and meditation practice brings up the memories of the Zazen course I took in Japan. The Zazen course was taught in a Japanese temple. The buildings of temple was magnificent but not exaggeration. It locates in a beautiful mountain surrounding by trees and rivers. When I first arrived the temple, I was stunned by the scene of temple, and the environment brings me a sense of peace. Sitted on a plain mat, we practice the Zazen in a room with a dim light and sound of winds, emptying our mind to find the inner peace. Even though the Zazen practice make me feel slumber sometimes, it was a nice experience of feeling the inner peace in such a beautiful place. Although I can't do the Zazen at the temple now, I will try to practice it at my room, focusing on sensation of body and feeling the peace.

Hast du mal Lust an diesem Wochenende was gemeinsam zu unternehmen? Ich habe ein bisschen recherchiert, was unsere Stadt zu bieten hat, und hier sind meine Vorschläge: 1) Am Freitagabend in Cinema Park gibt es eine Dokumentation über Martha Cooper, eine renommierte Fotografin aus New York, die durch ihre Bildband über New York Graffiti bekannt wurde. 2) An gleichem Abend gibt es in der Philharmonie ein Konzert "Orgel im Hollywood", wo Maria Blazevic sowie die Soundtracks von Hollywood Films (wie "Harry Potter" oder "Der Herr der Ringe"), als auch klassische Musik spielt. 3) Oder wir können ins Planetarium gehen. Am Freitag gibt es eine Show der Europäischen Weltraumbehörde namens "Eine Reise zu den Milliarden Sonnen". Die würde ich gerne besuchen, ich habe noch nie in meinem Leben im Planetarium gewesen. 4) Am Sonntag gibt es im Russischen Schauspielhaus ein Theaterstück "Der Beweis" von David Auburn. Dafür hat er im Jahre 2001 einen Pulitzer-Preis bekommen. Es geht um eine Tochter eines gestorbenen Mathematikers, um ihre mentale Gesundheit und den mathematischen Satz, den ihrer Vater zu Lebzeiten nicht veröffentlicht hatte. Der Beschreibung nach, hört es sich ziemlich spannend an. 5) Außerdem können wir ins Restaurant "Azyk-Tulek" gehen und baschkirische Spezialitäten kosten — das an jedem beliebigen Tag.

Some people argue that subjects like music, art and drama should share the equal importance with other school subjects. This essay totally agree with this statement because it helps students to develop their potential and to relax.
Providing primary students with more subjects like music, art and drama encourages them to fully develop their own potential in their young age. This is to say that classes like music and art service as a stimulus to help students to find out their own talents since gifts for different fields vary from person to person. Therefore, children can figure out what they good at with more exposure to related fields because their ability in this field can be fully developed only if it can be found in their young age. For example, it was continuous practice since his was 11 that make Langlang one of the most renowned pianist in China.
Giving the same importance on subjects like music and drama is a good way to relief students from their heavy study. In other words, now that students are under considerable pressure in academia because they are asked to become top students in classrooms by their parents as well as society, they tend to hit their books all days. In this way, their will be burned out, which is detrimental to their body and psychology. For example, a survey from Tianjin university shows that teenagers from schools where more music and drama courses are provided are healthier both in their physical and psychological than those who from schools where provide less.
In conclusion, I totally agree with that schools should put more focus on subjects like music and drama because it makes a contribution to develop students potential by motivating them and it also serves as a good method to unwind.

Hallo. Mijn naam is Dawid en ik kom uit Polen. Ik ben 24 jaar oud en ik werk in HR bij Philips. Ik woon in de derde grootste stad van Polen - Łódź. Ik spreek vloeiend Pools en Engels. Ik leer Spans en Nederlands. Ik woon in het centrum van de stad in een klein appartement. Mijn vrienden wonen in andere regio's dus ik reis vaak. Ik vind reizen heel boeiend. Ik ben in veel Europese landen geweest maar in het Western van het continent dus ik wil ooit ook Oekraïne of Moldavië bezoeken. Na het werk kook ik graag. Ik kan geweldige sushi maken! Als ik vrij heb, kijk ik vaak Netflix of ik lees boeken. Meestal in het Engels of in het Nederlands. Mijn niveau van het Spaans is te laag om dit te doen. In het Pools vind ik het zinloos omdat ik de taal elke dag gebruik. Ik hoop dat de corona virus snel voorbij is zodat ik naar een restaurant of kroeg kan gaan. :)

Basé sur mon nom, des gens souvent assument que je suis une fille, mais ce n'est pas le cas. Je suis un garçon de 30 ans d'origine Russe. Je suis chercheur. Je travaille en chimie à l'université. 我和老妈聊了颇长一段时间的天。我心里存在着矛盾。一个方面就是我一生中依赖和毫无怀疑地相信她。据我所知,我老妈从来没有说谎,而且她目前说的也跟事实一致。同时另一个方面是,她的故事听起来像虚构作品一样的难以置信。就像一位业余作家坐在咖啡厅一边喝杯咖啡一边写着短篇小说。有的人相信地球是平的、月球着陆是精心虚构的,还有无数其他的阴谋论。也许老妈在互联网找到了这样的网站,被阴谋论者洗脑。
我无语了,想着想着。老妈坐在对面,期待地望着我。过了一会儿,我问道:“那,我的老爸呢?”
她的眼神变成了更不耐烦,说:“儿子,你没听见我说的呢?你没有老爸。”
我忍不住喊道:“这不可能啊~。如果这是一种恶作剧,那么我觉得不好笑。”
我的话让老妈失望地叹了口气,说:“20年来,没有人相信我。你也不会呢?我不是在撒谎!我不是在骗你!”那时,老妈站了起来,开始收拾东西准备走。她补充道:“希望有一天你会了解。那一天打翻了我的世界。我所有的亲戚和朋友迟早感到耻辱而减少联络了。我不告诉你是为了保护你不遭受同样冷淡的对待。”
我问道:“那你为什么在疫情期间内来这里告诉我?”
她说:“我再也受不了了!你难道觉得我喜欢自己的生活方式?我受够了!算了。我现在告诉过你了,所以这种折磨结束了。”

In my workplace shift begins with roll call and his name was one of the few that I've easly learned and known who it belongs to. He caught my attention in the first sight, he seemed to be a very cool person. Confident. Funny. Experienced with work and people. He given this kind of "high school boy" vibe, even though he looks like full grown up men with his more than averge atlethic body and beard. But his attitude, jokes and sparkles in the eyes shown his very young, boyish spirit.
I think he didn't notice me at all. I was quiet, focused on doing my job. For first months completely uninterested in making friends or any socialization.
Things changed with the new year and his email - invitation for running session. I have a past with running. I came up to him to ask about details. In the ned those running session didn't work out, but at least or more importantly it started our relationship.
It grows slowly, organicaly.
I believe that for the beginning he was talking to me just to kill the time, to do anything except work. Maybe later he was talking to me bacuase I was always ready to listen about his passion.
He started to put tricks on me and I did not remain in debt. From turning off a device one of us was using or shooting the rubber band at each other to jostling and wrestling. It was fun, I smiled and laughed a lot thanks to him.
One of the reason I trusted him and felt comfortable around him was that I've known his girlfriend. She was working at the same company, but at higher position. She was beautiful, smart and kind. A bit intimidating for me. Because I respected her, I thought "If she trust him, then he must be a good guy and I can trust him as well".
We went to run together once. He gave me his banana to my oatmeal. During my vaccation I was updateing him how my running is doing. You know, small things. We were jus a colleagues from work.
There was... an accident in my family. He was one of the few that asked me what's wrong with concerd. He respected that I didn't want to talk about it and offered me a hug which I accepted.
Some time later there was something abviously wrong with him. I wasn't brave enough to ask why. I tried to find a balance between joking around and leaving him alone in peace. I wanted to my action speak "hey, if you need me I'm here, you can talk with me what's on your mind or I can help with distracted you from trouble". Even though I was full of doubts. Should I engage more? He surely have more trusted family and friends which he can talk with, who can give him a good advice and comfort.
I don't have enough wisdom nor experience to be a good advisor. I could only said to him "I'm sorry".
Some time later he said that actually my reaction was one of the best and that chocolate bar I bought, put in the box and throw at him from the distance (I tried to remain anonymous but somehow he figured me out) made him feel a little better.
Ironically, I asked his girlfriend what kind of sweets he likes and she suggested me that chocolate bar. Later I learned that she broke up with him and that was a reason for his anger and sadnes.

Lately, there are many people who study with electronic devices like iPad. That looks great because of beautiful templates, variety colors, unlimited space, ease of searching. I also like to use the device and program like Evernote on PC. It helps me organize everything in one space and I can access anytime, anywhere.
However, it's not all mighty tool. It's very effective to record something, but not effective to study something. I can't take intense concentration on what I study at all when I use the electronic device. I don't mean game or youtube, but "not paper". Paper is a very crucial material. Without paper, I don't feel like I'm studying (actually I can't memorize anything from the monitor.). I know there are people who it doesn't matter to use paper. They are grown up with these devices and used to it.). But, as one of the analogue person, I really need paper and I'd like to buy a suitable printer.
